What is a slip, trip and fall?

The simplest distinction between slip and trip claims is that:

  • Slips are caused by too little friction between someone’s footwear and the floor surface. This could be the result of a spillage, a loose mat or equipment on the floor, flooring with varying traction or weather hazards.
  • Trips are caused by a foot striking or colliding with an object, which causes a loss in balance. This could be the result of poor lighting, an uneven floor surface, cables, or clutter.

Both slips and trips lead to falls, which are where injuries can occur.

Can I claim for a slip, trip and fall accident?

You may be able to claim for slip, trip and fall accidents where it can be shown that you have been injured and it is someone else’s fault.

For example, if you slipped over due to a wet floor surface, and there were no signs to indicate that the floor was wet, you may be able to make a claim as there was not sufficient warning that there was a hazard.

Another example may be where you have tripped over an uneven surface which has not been properly maintained.

How long after a fall can you claim compensation?

According to slip trip and fall legislation, you will typically have three years to bring forward a claim if you have been injured following a slip, trip or fall.

The three-year time limit is counted from the ‘date of knowledge’. This is when you were first aware that:

  • You had suffered an injury as a result of a slip, trip and fall.
  • Someone else was to blame for the injury.

There are some exceptions to this general rule. These include where:

  • The injured party lacks mental capacity. Where this is the case, there is no time limit for someone to make a claim for a fall on their behalf.
  • The injured party is under 18. A claim can be made at any time until they turn 18, from which point a claim can be brought until they turn 21.

How do I know who was responsible for a slip, trip or fall?

Knowing who was responsible for a slip, trip, or fall will depend on where the accident took place.

If you fell in a building with public access, the responsibility will fall with the building’s owners. This is the same for retail spaces, or restaurants.

If you fall in the street, perhaps due to ice, an uneven paving stone or a faulty staircase, the responsible party will usually be the council or local authority.

Avoidable slips, trips or falls at work will be the fault of the employer responsible for breaching their duty of care towards you.
