What is GP negligence?

As a patient, you are owed a duty of care by healthcare professionals, including your GP. If this care falls below the standard that is reasonably expected of a professional and you suffer harm or a worsening of your condition as a result, you may be entitled to compensation.

If you are entitled to make a GP medical negligence claim, you can expect two types of compensation:

  • General damages; and
  • Special damages

General damages are to compensate you for the pain and suffering that have been caused, as well as for any loss of amenity or loss in the quality of your life.

Special damages are to repay any financial losses that have arisen because of your GP’s negligence. This could include loss of earnings, the cost of special equipment and travel expenses to medical appointments.

When is a GP negligent?

A GP is negligent if the care they provide falls below the standard of care that is reasonably expected of a GP. While they may not have expertise in individual areas of medicine, part of their role is to identify potential problems and make referrals to experts where necessary.

They should also interpret test results accurately, make clear records and prescribe the correct medication. Urgent cases should be identified and the patient admitted to hospital.

How does a GP assess a patient’s condition?
